Neutrality of arbitrators against the backdrop of the relationship between arbitrator and co-arbitrator or counsel
While one usually assesses the question of arbitrator neutrality by considering his/her relationship to a party (including related parties and affiliates), with detailed disclosure requirements including the past, the links between an arbitrator and his/her co-arbitrator as well as counsel appearing before him/her often plays a subordinate role.
A panel of distinguished arbitration specialists will explore what kinds of relationships should be acceptable or not, and whether the IBA Guidelines provide sufficient rules on this question. The discussion will be animated by the following discussants:
